This End User License Agreement (“EULA”) is a legal agreement between you (“User”) and Fashion Digg (“Company”) regarding your use of the Taking Smarty mobile application (“App”). By installing and using the App, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not install or use the App.
- License
Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on devices that you own or control, in accordance with the terms of this EULA and the App Store terms and conditions.
- Restrictions
You agree not to: a. Modify, reverse engineer, disassemble, decompile or create derivative works based on the App; b. Remove any copyright or other proprietary notices from the App; c. Rent, lease, lend, sell, redistribute, or sublicense the App; d. Use the App for any illegal or unauthorized purpose.
- Intellectual Property
All rights, titles, and interests in and to the App, including all copyrights, trademarks, and other intellectual property rights, are owned by Fashion Digg or its licensors. No rights are granted to you other than the limited license specified in Section 1.
- Updates
Company may, from time to time, provide updates or upgrades to the App. These updates may include bug fixes, new features, or improvements. Company reserves the right to update or discontinue the App at any time without notice.
- Termination
This EULA is effective until terminated by you or Company. Your rights under this EULA will terminate automatically without notice from Company if you fail to comply with any terms of this EULA. Upon termination of this EULA, you must cease all use of the App and delete all copies of the App from your devices.
- Disclaimer of Warranties
The App is provided “as is” and “as available” without any warranties, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Company does not warrant that the App will be error-free, uninterrupted, or that defects will be corrected.
- Limitation of Liability
In no event shall Company be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of or inability to use the App, even if Company has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
- Governing Law
This EULA shall be governed by and construed in accordance with the laws of United State, without regard to its conflict of law provisions. Any disputes arising from this EULA shall be resolved in the appropriate courts of United State.
